Terms of Service

These Terms of Service ("Terms") govern your access to and use of Cadence ("Service"), operated by Bigger Dreams, LLC ("we", "us"). By creating an account, you agree to be bound by these Terms.

1. The Service

Cadence is a multi-brand social-media scheduling and publishing tool that lets users schedule, publish, and track posts to connected platforms including TikTok. The Service is delivered as a hosted SaaS product.

2. Account creation

You must provide accurate registration information. You are responsible for maintaining the confidentiality of your password and for all activities under your account. You must be at least 13 years old (16 in the EU) to use the Service.

3. Subscription and billing

  • Cadence offers a free tier with limited posting capacity and paid subscription tiers with expanded features.
  • Paid subscriptions are billed monthly or annually via Stripe.
  • You may cancel at any time from Settings → Billing. Cancellation takes effect at the end of the current billing period; no pro-rated refunds.
  • We may change pricing with 30 days advance notice. Continued use after the price change constitutes acceptance.

4. Acceptable use

You agree not to:

  • Upload content you don't own or have explicit rights to publish
  • Use Cadence to violate TikTok's Community Guidelines or any platform's terms of service
  • Spam, harass, impersonate, or post misleading content
  • Reverse engineer, decompile, or attempt to extract source code
  • Use the Service for unlawful purposes
  • Resell or sublicense Cadence access without written permission

Violation may result in immediate account termination without refund.

5. Content ownership

You retain all rights to content you upload. You grant Cadence a limited license to process, transmit, and store your content solely to provide the Service.

6. Connected platform terms

Use of Cadence to publish to TikTok (or any other connected platform) is subject to that platform's own Terms of Service. Nothing in these Terms overrides those.

7. Disclaimers

The Service is provided "AS IS" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or that scheduled posts will always publish successfully (platform API failures, outages, or rate limits may cause delays or failures).

8. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising from these Terms or the Service is limited to the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

9. Termination

We may suspend or terminate your account for material violation of these Terms with reasonable notice (immediate for severe violations including spam, fraud, or platform-rule violations).

10. Indemnification

You agree to indemnify Cadence against any third-party claims arising from content you publish through the Service or your violation of these Terms.

11. Governing law

These Terms are governed by the laws of the State of California, USA. Disputes shall be resolved in Los Angeles County courts.

12. Changes to Terms

We may update these Terms. Material changes will be announced by email at least 30 days before they take effect.
